Refund, Return & Cancellation Policy

 

This Refund, Return & Cancellation Policy applies to all purchases, custom orders, wholesale orders, bulk orders, private-label orders and made-to-order products purchased through SportswearBay.com.

By placing an order with SportswearBay, the customer confirms that they have read, understood and agreed to this policy.

1. Custom-Made Products

SportswearBay specializes in custom sportswear, teamwear, fishing apparel, performance apparel, jerseys, hoodies, private-label clothing and other products manufactured according to customer specifications.

Because these products are manufactured specifically for the customer, custom-made and personalized products are not eligible for return, exchange or refund due to change of mind, personal preference or other reasons unrelated to a confirmed manufacturing error by SportswearBay.

This includes, but is not limited to:

  • Custom fishing shirts

  • Custom performance shirts

  • Custom jerseys

  • Custom hoodies

  • Teamwear

  • Sublimated apparel

  • Private-label apparel

  • Products containing customer logos

  • Products containing customer artwork

  • Products containing names or numbers

  • Custom colors or patterns

  • Custom labels and branding

  • Custom sizes or measurements

  • Wholesale and bulk production orders

Once production has started, the order is considered final and non-cancellable, except where SportswearBay agrees otherwise in writing.

2. Customer Design and Information Responsibility

The customer is responsible for providing accurate information required to manufacture the order.

This includes:

  • Logos

  • Artwork

  • Names

  • Numbers

  • Spelling

  • Colors

  • Size information

  • Measurements

  • Quantity

  • Product specifications

  • Branding instructions

  • Shipping information

The customer confirms that they have the legal right or permission to use all logos, trademarks, artwork, photographs, names and other intellectual property supplied to SportswearBay.

SportswearBay is not responsible for claims arising from artwork, trademarks, logos or other materials supplied by the customer.

3. Artwork and Mockup Approval

Where a digital mockup, artwork proof or sample is provided, the customer must carefully review and approve it before production.

Approval confirms that the customer has accepted the design and specifications shown in the approved artwork, including where applicable:

  • Colors

  • Logo placement

  • Artwork

  • Text

  • Names

  • Numbers

  • Design elements

  • Product style

  • Branding

  • General appearance

Once approved, the customer accepts responsibility for the approved specifications.

SportswearBay will not be responsible for errors that were visible in the approved artwork, mockup or sample.

Customers are encouraged to request corrections before giving final approval.

4. Samples and Prototypes

Sample, prototype, design, setup, development and other pre-production charges are generally non-refundable.

A sample is a separately manufactured product and its cost includes materials, labor, production and development expenses.

If a customer decides not to proceed with a bulk order after receiving or approving a sample, the sample and related charges remain non-refundable unless SportswearBay has agreed otherwise in writing.

5. Order Cancellation

Cancellation requests must be submitted to SportswearBay in writing as soon as possible.

SportswearBay may accept a cancellation request only if production has not started and the order has not already incurred non-recoverable costs.

If production has not started, SportswearBay may, at its discretion, approve cancellation after deducting any applicable costs already incurred, including:

  • Design costs

  • Artwork costs

  • Sample costs

  • Materials purchased

  • Fabric purchased

  • Printing or production preparation

  • Payment processing fees

  • Other reasonable costs related to the order

Once cutting, printing, embroidery, sublimation, stitching, decoration, labeling, packing or other production activities have started, the order cannot normally be cancelled and the customer is not entitled to a refund.

6. No Change-of-Mind Returns

SportswearBay does not accept returns or refunds because the customer:

  • Changed their mind

  • No longer needs the products

  • Does not like the design after approval

  • Does not like the color after approval

  • Ordered the wrong quantity

  • Ordered the wrong size

  • Provided incorrect measurements

  • Provided incorrect information

  • Changed their branding requirements

  • Missed an event or tournament

  • Changed their team requirements

  • Found another supplier

  • Decided not to use the products

Custom products cannot normally be resold to another customer and therefore cannot be treated like standard retail merchandise.

7. Incorrect Sizes and Measurements

Customers are responsible for selecting or providing the correct sizes and measurements.

SportswearBay is not responsible for incorrect sizing where the products were manufactured according to the customer's submitted or approved size information.

A difference between a customer's personal expectation of fit and the approved size specifications does not automatically constitute a manufacturing defect.

For custom or team orders, customers should review the applicable size chart and measurement information before approving production.

8. Manufacturing Defects or Production Errors

SportswearBay stands behind its manufacturing work.

If SportswearBay confirms that an item has a genuine manufacturing defect or that the delivered product materially differs from the approved specifications because of an error made by SportswearBay, SportswearBay may, at its discretion:

  1. Repair the affected product;

  2. Remake the affected product;

  3. Replace the affected product;

  4. Provide a partial refund or credit for the affected product; or

  5. Provide another reasonable resolution agreed with the customer.

The remedy will depend on the nature and seriousness of the confirmed issue.

A confirmed defect affecting some items does not automatically entitle the customer to a refund for the entire order.

9. What Qualifies as a Manufacturing Error

Examples may include:

  • A materially incorrect product supplied by SportswearBay

  • A significant manufacturing defect

  • A substantial printing or sublimation error caused by SportswearBay

  • A significant embroidery or stitching defect

  • An incorrect size supplied compared with the customer's approved size information

  • A material customization error caused by SportswearBay

  • A product materially different from the final approved specifications

Minor imperfections, normal manufacturing variations or differences within reasonable production tolerances do not automatically qualify as defects.

10. Manufacturing Tolerances

Custom garment manufacturing involves reasonable production tolerances.

Minor variations may occur in:

  • Color

  • Shade

  • Position

  • Measurements

  • Stitching

  • Fabric texture

  • Printing

  • Sublimation

  • Embroidery

  • Finishing

  • Individual garment dimensions

Such minor variations, where they remain within commercially reasonable manufacturing tolerances, are not considered defects.

Colors displayed on computer monitors, mobile phones and other screens may also differ from the final physical product.

11. Defective or Incorrect Products Claim Period

Any claim concerning a damaged, defective or incorrectly manufactured product must be submitted to SportswearBay within 7 calendar days of delivery.

Claims submitted after this period may be rejected unless SportswearBay determines otherwise at its sole discretion.

The customer must provide sufficient evidence, which may include:

  • Order number

  • Clear photographs

  • Video evidence where appropriate

  • Photographs of packaging

  • Description of the issue

  • Details of the affected quantity

  • Other information reasonably requested by SportswearBay

SportswearBay may request additional evidence before approving a claim.

12. Inspection Before Use

Customers should inspect products immediately after delivery and before:

  • Washing

  • Wearing

  • Altering

  • Printing

  • Embroidering

  • Cutting

  • Rebranding

  • Reselling

  • Distributing

  • Further processing

Products that have been altered, washed, damaged, worn improperly or modified by the customer or another party may not be eligible for replacement or refund.

13. Shipping Damage

Customers should inspect the shipment as soon as it is received.

Where the outer packaging appears damaged, customers should photograph the package and its contents before disposing of the packaging.

Shipping-related claims must be reported within 7 calendar days of delivery, together with appropriate photographic or video evidence.

SportswearBay will review the circumstances and determine the appropriate resolution.

14. Lost, Delayed or Held Shipments

Shipping times are estimates and are not guaranteed unless SportswearBay has expressly agreed to a guaranteed delivery service in writing.

SportswearBay is not responsible for delays caused by:

  • Courier companies

  • Customs authorities

  • Import procedures

  • Weather

  • Natural disasters

  • Strikes

  • Government restrictions

  • Political events

  • Transportation disruptions

  • Incorrect customer shipping information

  • Recipient unavailability

  • Customs duties or clearance issues

  • Events outside SportswearBay's reasonable control

Where a shipment is delayed or held by a carrier or customs authority, SportswearBay will reasonably assist the customer in communicating with the relevant carrier or party.

15. Customs Duties and Import Charges

For international orders, the customer is responsible for any applicable:

  • Customs duties

  • Import taxes

  • VAT

  • Brokerage charges

  • Clearance fees

  • Local government charges

  • Other destination-country charges

Failure or refusal to pay applicable import charges does not automatically create a right to a refund.

If an order is returned to SportswearBay because the customer refused delivery or failed to complete customs requirements, the customer may remain responsible for shipping, return shipping, customs charges and other costs incurred.

16. Refund Amount

Where SportswearBay approves a refund, the refund may be limited to the value of the affected product or affected portion of the order.

Unless required by applicable law or otherwise agreed in writing, SportswearBay is not responsible for:

  • Lost profits

  • Lost business

  • Missed tournaments

  • Missed events

  • Advertising expenses

  • Marketing expenses

  • Replacement supplier costs

  • Business interruption

  • Travel expenses

  • Event expenses

  • Other indirect or consequential losses

17. Shipping Charges

Original shipping charges are generally non-refundable unless the refund is specifically approved because of a confirmed error attributable to SportswearBay or applicable law requires otherwise.

Where SportswearBay agrees to remake or replace products because of a confirmed manufacturing error, SportswearBay will determine the appropriate shipping arrangement on a case-by-case basis.

18. Chargebacks and Payment Disputes

Customers agree to contact SportswearBay first and provide SportswearBay with a reasonable opportunity to resolve an order-related issue before initiating a payment dispute or chargeback.

A chargeback does not automatically establish that the customer is entitled to a refund.

SportswearBay reserves the right to provide the payment processor, bank or financial institution with relevant order records, approved artwork, production records, delivery information, correspondence and other evidence relating to the transaction.

19. Wholesale and Bulk Orders

Wholesale, team, corporate, private-label and bulk orders are subject to the same principles described in this policy unless different terms have been expressly agreed in writing before production.

Because bulk orders involve substantial manufacturing commitments, customers should carefully review all specifications before approving production.

20. Customer-Supplied Materials

If the customer supplies logos, artwork, garments, labels, fabrics, packaging or other materials, SportswearBay is not responsible for defects, limitations or performance issues originating from those customer-supplied materials.

SportswearBay may refuse or suspend production where supplied materials are unsuitable for the requested manufacturing process.

21. Force Majeure

SportswearBay will not be responsible for failure or delay caused by circumstances beyond its reasonable control.

Such circumstances may include natural disasters, fire, flood, epidemic, war, civil unrest, government restrictions, strikes, power failures, transportation disruptions, supplier failures, customs restrictions or other extraordinary events.

SportswearBay will make reasonable efforts to complete affected orders once circumstances permit.

22. No Automatic Refund

Submitting a claim does not automatically mean that a refund, replacement or return will be approved.

Each claim will be reviewed based on:

  • Order information

  • Approved specifications

  • Artwork or mockup

  • Production records

  • Evidence supplied by the customer

  • Nature of the claimed issue

  • Quantity affected

  • Applicable circumstances

SportswearBay will determine the appropriate resolution after reviewing the available information, subject always to applicable law.

23. Returns Must Be Authorized

Customers must not send products back to SportswearBay without receiving written authorization.

Unauthorized returns may be refused or may not be processed.

If a return is authorized, SportswearBay will provide the applicable return instructions.

24. Refund Processing

Where a refund is approved, SportswearBay will normally process it through the original payment method where reasonably possible.

The time required for the funds to appear in the customer's account may depend on the customer's bank, card issuer, payment provider or financial institution.

SportswearBay is not responsible for delays caused by a third-party payment provider after the refund has been processed by SportswearBay.

25. Policy Does Not Exclude Mandatory Legal Rights

Nothing in this policy is intended to exclude, restrict or remove any right, remedy, responsibility or liability that cannot lawfully be excluded or restricted under applicable law.

Where applicable law provides a mandatory consumer right or remedy that conflicts with this policy, the mandatory legal requirement will apply to the extent of the conflict.

26. Policy Changes

SportswearBay reserves the right to update or modify this policy from time to time.

The version applicable to an order will generally be the version in effect when the order was placed, unless otherwise required by applicable law.

ALL CUSTOM ORDERS ARE MADE SPECIFICALLY TO CUSTOMER REQUIREMENTS. ONCE PRODUCTION HAS STARTED, CUSTOM ORDERS CANNOT NORMALLY BE CANCELLED, RETURNED OR REFUNDED DUE TO CHANGE OF MIND, INCORRECT CUSTOMER-SUPPLIED INFORMATION, SIZING, DESIGN PREFERENCE OR OTHER REASONS UNRELATED TO A CONFIRMED MANUFACTURING ERROR.

PLEASE REVIEW AND APPROVE ALL DESIGNS, SIZES, COLORS, LOGOS, NAMES, NUMBERS AND OTHER ORDER DETAILS CAREFULLY BEFORE PRODUCTION.
